This Food AI Mate Privacy Policy ("Privacy Policy") governs the Personal Data (as defined below) collected from or processed about you when you use the Food AI Mate mobile application ("Food AI Mate", the "app", or the "application"), including by downloading, installing, accessing or otherwise using the application (collectively referred to herein as "Use").
We provide this Privacy Policy to explain our practices for collecting, using, processing, and disclosing the Personal Data we process about Food AI Mate users ("users", "you", or "your", as applicable), and to tell you about the rights you may have in relation to your Personal Data and choices you may be able to make in relation to it. By Personal Data we mean (i) information that is associated with an identified or identifiable natural person, and (ii) protected as personal data under applicable data protection laws.

Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device¡¯s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
3.PERSONAL DATA YOU PROVIDE TO US DIRECTLY
You may provide Personal Data to us directly, or to service providers that act on our behalf, when you Use Food AI Mate. The Personal Data you provide depends on which features of Food AI Mate you Use and how you interact with the app.
- Photos that you upload to Food AI Mate. If you grant us permission to access your camera or your device¡¯s photo library, we will process the photos you select to upload to Food AI Mate to provide features of the app that you choose to Use.
- If you contact us or communicate with us, we will collect and receive records and copies of your correspondence with us and contact details that you have provided us while making your inquiries (such as your name, postal addresses, email addresses and phone numbers or any other identifier by which you may be contacted).
4.HOW WE PROCESS, SHARE, AND RETAIN YOUR PHOTOS AND IMAGE DATA
- To provide and maintain our Service, including to monitor the usage of our Service.
For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
- To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
- To manage Your requests: To attend and manage Your requests to Us.
For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
Will the data be shared with any third parties
We do not rent, sell or share your data (including photos) with any third party outside of the company or its affiliates.We will not use your personal data for training and/or creating separate AI/products.
5.PERSONAL DATA WE COLLECT AUTOMATICALLY
When you Use Food AI Mate, we or third parties we permit to do so, may automatically collect certain information, including Personal Data, from you (this is subject to your consent where this is required by law). The information collected from you automatically when you Use Food AI Mate may include:
- Device information: Information about your mobile device and internet connection, including your IP address, the device¡¯s unique device identifier, operating system and version, mobile network information, device type and device language.
- App and country information: Information regarding the version of the app that you are using and the country version of the app store from which you downloaded Food AI Mate.
- Image Data.
- Usage details: Details of your Use of Food AI Mate, including frequency of Use, areas and features of the application that you access and information regarding engagement with particular features of the app.
- Information about your subscription£º
Details confirming the existence of relationship between us and confirmation that relationship ended, if applicable (e.g., subscription order, payment confirmation, subscription cancellation, subscription price & duration, if you used the app), and information about your subscription status and redacted cardholder data (this doesn¡¯t include your full card details)
Payment Information
Our e-commerce provider (Apple) is responsible for billing, processing and charging for in-app purchases, handles your personal information and keeps it absolutely safe and secure. This information is processed as part of the performance of the contract between you and us. We cannot access or use your credit or debit card information.
You may access the applicable ¡°in-app¡± purchase rules and policies directly from the app stores.
Other than with respect to Image Data, we and third-parties we engage may use cookies, Software Development Kits (SDKs), and other tracking technologies to automatically collect the Personal Data set forth above.
6.THE PURPOSES AND OUR LEGAL BASES FOR PROCESSING YOUR PERSONAL DATA
We may use your Personal Data for a variety of purposes depending on the category of Personal Data and the way you Use and interact with the Food AI Mate, including the following:
- To present to you and others with Food AI Mate and its contents and any other information, products or services that you request from us, including to provide various features of the app and its functionality. We do so to provide you with the services subject to your explicit consent and according to our contractual obligation.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us in relation to Food AI Mate (e.g., the Terms of Use). This is for the performance of our contract with you and for our legitimate interests in performing and enforcing our contracts with you and/or to defend our rights in case of claims.
- To provide you with customer and technical support, investigate your concerns, respond to your inquiries and to monitor and improve our responses to your and other users¡¯ inquiries in relation to Food AI Mate. It is our legitimate interest to provide you with high-quality support.
- To conduct research, analytics and monitor performance and other metrics regarding Food AI Mate and your Use of Food AI Mate. This may include data regarding the total number of users of our app and traffic.
- To improve, test, and monitor the effectiveness of Food AI Mate. It is our legitimate interest to conduct such analyses to understand our product and business metrics.
- In any other way as we may describe when you provide the information or otherwise at your direction or with your consent.
- As permitted or required by law, including for auditing, fraud and security monitoring purposes.
7.TO WHOM WE DISCLOSE PERSONAL DATA
We may disclose the information we process about you, including any Personal Data, as follows:
- We may disclose your Personal Data, and other collected information to third-party organizations such as contractors, business partners, service providers, and vendors that we use to support our business and who assist us in providing Food AI Mate.
- We may disclose your Personal Data to third-party analytics providers and advertising partners or otherwise permit them to collect or access it.
- We may disclose your Personal Data in response to legal requests and for purposes of preventing harm. We may access, preserve and share your information in response to a legal (like a search warrant, court order or subpoena), government or regulatory request if we have a good faith belief that the law requires us to do so. This may include responding to legal, government or regulatory requests from jurisdictions where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: (i) detect, prevent and address fraud and other illegal activity; (ii) protect ourselves, you and others, including as part of investigations; and (iii) prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.
-We also use third-party analytics tools like Facebook SDK and Adjust to help us measure traffic and usage trends for Food AI Mate and for other purposes. Such analytics tools collect information via third-party SDKs incorporated into Food AI Mate, which includes information about features of Food AI Mate you visit or Use, your actions in Food AI Mate, and information about your subscription. Such information may be used to provide content, advertising, or functionality or to measure and analyze ad performance on Food AI Mate or other websites or platforms. Third parties may also use such information for their own purposes.
8.DATA SECURITY
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.
9.Children¡¯s Privacy
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent¡¯s consent before We collect and use that information.
